PLEASE NOTE: These Terms & Conditions apply exclusively to purchases made through the Chillmax online store. For in-person or trade service enquiries, separate terms may apply.

Pricing & Payment
Pricing
All prices quoted are in New Zealand Dollars (NZD). Unless explicitly stated otherwise, prices are GST-exclusive, and GST will be added where applicable. While we take every care to ensure the accuracy of our pricing, Chillmax reserves the right to correct any errors or omissions.
Payment Methods
We accept payment via POLi (online bank payment) or Pay on Invoice. No credit card or cash payments are accepted through our online store.
Upfront Payment for Confirmed Jobs
A deposit or full payment may be required prior to commencement of work, depending on the nature and scale of the job. Specific deposit requirements are outlined in the Installation section below.
Pay on Invoice – Payment Terms
For customers selecting the Pay on Invoice option, payment must be made in full within 7 days of the invoice date. Goods will not be dispatched until payment has been received and a confirmation of payment has been sent to us.
If payment is not received within 7 days, the order will be automatically cancelled and the goods will be made available for sale again.
Please note: This section applies to Pay on Invoice orders only. POLi payments are processed instantly at the time of purchase and are not subject to invoice terms.
Service Delivery
Scheduling & Timeframes
Any timeframes or scheduling estimates provided by Chillmax are indicative only. While we make every effort to honour agreed appointment times, we accept no liability for delays arising from circumstances outside our reasonable control.
Retention of Title
Ownership of all parts, equipment, and materials supplied by Chillmax remains with Chillmax until full payment has been received. Chillmax retains a security interest in all supplied goods in accordance with the Personal Property Securities Act 1999 (PPSA).
Returns, Refunds & Your Rights
Faulty or Damaged Goods – Your Rights Under the CGA
Under the Consumer Guarantees Act 1993, if a product is faulty, not of acceptable quality, or does not match its description, Chillmax will meet its legal obligations to provide a remedy. Depending on the nature of the fault, this may be a repair, replacement, or refund.
If you receive a faulty or damaged product, please contact us immediately with your order details and a description of the issue so we can arrange an appropriate solution as quickly as possible.
Change of Mind – Our Policy is Final
Please choose your products carefully. As a firm policy, Chillmax does not offer refunds, returns, or exchanges if you change your mind, order the wrong product, or your circumstances change.
This policy exists because we operate as a dropship-based business and our suppliers do not permit returns for these reasons. All purchases from Chillmax are considered final sales.
In very exceptional circumstances, a return may be considered entirely at our sole discretion. If we agree to make an exception, the following strict conditions will apply without negotiation:
- The product must be brand new, unopened, and in its original sealed packaging.
- A 20% restocking fee will be deducted from any credit amount.
- All costs associated with returning the item are the responsibility of the customer.
- Original shipping costs and any payment processing fees are non-refundable.
Commercial Customers
Where goods are acquired for business purposes, the customer agrees that the Consumer Guarantees Act 1993 does not apply to that transaction.
Refrigeration & Air Conditioning Installation
Installation services are not available through our online store. If you require installation of any equipment purchased from Chillmax, please contact our installation team directly for a tailored quote.
Our team will assess your specific requirements and provide you with a full installation quote, including any site-specific considerations. Installation terms and conditions will be provided separately at the time of quotation.

Warranties & Limitation of Liability
Third-Party Manufacturer Warranties
Where goods supplied by Chillmax are covered by a manufacturer’s warranty, we will assist customers in accessing those warranty entitlements. The terms of such warranties are governed by the relevant manufacturer and are separate from Chillmax’s obligations.
Limitation of Liability
To the maximum extent permitted under New Zealand law, Chillmax’s liability for any claim arising from the supply of goods or services is limited to the value of those goods or services. We shall not be liable for any indirect, consequential, special, or economic loss of any kind, including but not limited to loss of income, loss of use, or property damage arising from the failure of equipment or services not directly caused by Chillmax’s negligence.
General Provisions
Intellectual Property
All content produced by Chillmax, including quotes, reports, designs, technical drawings, and website content, is the intellectual property of Chillmax Refrigeration and Air Conditioning Services Limited. This material may not be reproduced, distributed, or used for commercial purposes without our prior written consent.
Fraud & Misrepresentation
Where Chillmax has reasonable grounds to believe that a customer has engaged in fraudulent conduct or provided materially false information, we reserve the right to report the matter to the appropriate authorities, including NZ Police and relevant regulatory bodies, and to pursue recovery of all associated costs.
Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of New Zealand. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Auckland, New Zealand.
